HEALTHCARE FALSE CLAIMS ACT, QUI TAM & CIVIL FRAUD
Healthcare False Claims Act Allegation or Whistleblower Evidence?
A healthcare False Claims Act issue may arise from a whistleblower’s documents, a government investigation, internal billing concerns or a dispute over the clinical justification for claims. A mistake is not automatically fraud, and a provider’s defense raises different questions from a potential relator’s claim. BOLO evaluates selected matters by examining what was billed, what the applicable rule required, who knew what and when, and whether the available evidence warrants legal action, subject to conflicts screening.

The FCA Issues BOLO Can Evaluate
Early legal analysis should identify what was actually billed, what the government paid, what the applicable requirements were, and which evidence supports or contradicts the allegation. A billing error does not automatically establish a knowing false claim.
Prospective Qui Tam Whistleblower Review
Initial evaluation of potential non-public evidence, claim-level records, the person’s role, possible public-disclosure or first-to-file concerns, and the procedures governing a relator action.
Provider and Business FCA Defense
Review of demand letters, civil investigative demands, subpoenas, allegations of inaccurate claims, documentation, medical necessity, or contractor findings that may contribute to an enforcement matter.
Healthcare Fraud & Referral Allegations
Analysis of reimbursement representations, medical-necessity questions, physician referral arrangements, compensation and vendor relationships, and the potential relevance of Stark or Anti-Kickback laws.
Documentation, Damages & Internal Review
Claim timelines, remittances, utilization patterns, source documents, privilege and preservation questions, and appropriate coordination of clinical, statistical, forensic, and other specialist review.
A Deliberate First-Stage Assessment
1. Conflicts and role screening
Determine whether the caller is a prospective relator, defendant, witness, owner, or other party. BOLO will not accept opposed sides of the same matter and screens former-government-service restrictions where relevant.
2. Evidence and legal-theory review
Identify the claim or transaction population, government funding connection, potentially material representations, applicable scienter standards, and records that could test the allegations.
3. Plan a lawful next step
Potential directions include additional investigation, careful document preservation, responding to a compulsory demand, or consulting separately admitted federal counsel for any necessary federal-court filing or litigation.
Frequently Asked Questions
Is a Medicare overpayment automatically False Claims Act liability?
No. FCA liability depends on specific statutory elements and evidence. Mistakes, disputed coverage questions, and knowing misconduct are not interchangeable.
Does a qui tam complaint become public immediately?
Federal qui tam actions have special initial filing and government-notice procedures, including a sealed filing in federal court. Procedural rules and case circumstances should be reviewed before taking any action or disclosing potentially protected information.
Can BOLO consider both whistleblower and defense matters?
The firm evaluates both categories, but not adverse roles in the same matter or another engagement barred by conflicts, confidentiality, or former-government-attorney rules.
Does an inquiry mean BOLO will file a federal lawsuit?
No. Representation, filing authority, counsel admission to the relevant federal court, litigation resources, and the suitability of a particular claim are assessed before any engagement.
