Website Terms & Electronic Communications
Effective October 14, 2026. These Terms include the Firm’s electronic communications policy for email, text, telephone, voicemail, video, visual evidence, electronic signatures and related records.
Scope and acceptance
These Terms of Service (“Terms”) govern your access to and use of the public website operated by BOLO Health Law, LLC (“BOLO,” “we,” “our,” or the “Firm”), including its informational materials, contact forms, scheduling tools and related online services. By using these website services you accept these Terms to the extent enforceable under applicable law.
A separate attorney-client engagement agreement governs representation, the scope of legal services, fees, responsibility for deadlines, and any matter-specific communication arrangements. Applicable professional rules and nonwaivable legal rights prevail over inconsistent website language.
General information is not individual legal advice
Website publications, articles, videos, summaries, checklists and references provide general information. They are not a legal opinion or advice tailored to your circumstances. Laws and administrative requirements change; statements may be incomplete or become outdated. You should obtain advice concerning your specific facts and deadlines. No outcome, result, reimbursement, settlement or regulatory decision is promised.
No automatic attorney-client relationship; prospective clients
Website visits, emails, contact-form submissions, text messages, voicemails, social-media messages, preliminary conversations, and appointment requests do not automatically establish an attorney-client relationship. Representation generally follows an appropriate mutual agreement and may require conflict screening, scope confirmation and engagement documentation.
Even without a resulting engagement, information communicated in a qualifying consultation with a prospective client may receive protection under New Jersey Rule of Professional Conduct 1.18 and other applicable law. We do not use these Terms to disclaim duties imposed by those rules.
Initial inquiries and sensitive information
Use the website form for a short description of the general legal issue, involved parties, jurisdiction and deadlines. Do not upload or include unnecessary patient-identifiable information, complete medical records, Social Security numbers, passwords, financial account credentials or other sensitive documents through an ordinary public form. BOLO may request additional information through a more secure process. An inquiry is not a commitment by the Firm to preserve a filing deadline, appeal right or administrative response date.
Electronic correspondence generally
BOLO may use email, phone, voicemail, text messaging, videoconferencing, electronic document exchanges, client portals and e-signature systems as appropriate to inquiries and matters. If you voluntarily provide contact details or initiate correspondence, we may reply through a reasonable channel as permitted by applicable law. Additional consent will be sought when legally required for a particular communication or technology.
Clients should advise the Firm if an address or device is shared, employer-controlled, monitored by an adverse party, or otherwise insecure. We may direct certain materials to a secure portal or other safer method and may ask for identity verification before releasing sensitive information.
Email communications
Email may be used for appointment coordination, document exchange, billing and legal communications. Messages or attachments can be delayed, misdirected, filtered, forwarded, intercepted or exposed by an insecure account. Ordinary email is not guaranteed to be encrypted end-to-end or free of security risk. Do not assume that an emailed deadline or urgent request has been received and accepted for action unless specifically acknowledged.
Text messages and SMS
SMS and MMS may be used for reasonable return-contact requests, scheduling, reminders and authorized administrative updates. Message frequency varies; standard message and data charges may apply. Recipients can request that nonessential texts stop by contacting the Firm or replying STOP to a supported messaging number, and may contact the Firm for help.
Consent to transactional or informational correspondence is not blanket authorization for automated advertising or promotional messages. Any required marketing consent will be obtained separately and is not a condition of obtaining legal services. We will honor applicable opt-out and consent-revocation requirements. Text messages are not recommended for highly sensitive information or legally urgent submissions.
Telephone and voicemail
Calls and voicemail may be used to receive inquiries and communicate during representation. We may retain appropriate voicemail and call-related records. A voicemail or missed call does not guarantee immediate response, establish representation or authorize the Firm to act before a deadline. Routine telephone calls are not represented as automatically recorded.
Audio/video recording, transcription and meeting summaries
Telephone calls, online meetings and other conversations may be recorded or transcribed only as permitted by applicable law and professional obligations, and with any required notice or consent. The location of participants and nature of the communication may affect what law applies. Any use of third-party transcription, automated summarization or AI-enabled processing of confidential legal discussions is subject to appropriate review and safeguards.
Participation in a virtual meeting is not itself blanket consent to recording future meetings. Attendees should request appropriate authorization before recording or distributing confidential meetings; nothing here prevents conduct affirmatively protected by law.
Videoconferencing and visual documents
Consultations and meetings may use third-party audiovisual services. Participants should join from a reasonably private location, use appropriate equipment, and avoid distributing access links to unauthorized people. Platforms may create chat logs, participant and connection records, or other technical data. Photographs, screenshots, recordings and other electronic evidence supplied for a legal matter may be retained as part of an appropriate file. BOLO may end or move a meeting if security, access or confidentiality concerns arise.
Electronic signatures and electronic records
Where permitted by applicable law and agreement, BOLO may use electronic delivery, acceptance and signatures for contracts, acknowledgments and related records. Additional electronic-transactions disclosures or consent may be required for particular documents. We may require identity verification, an original signature or a different method where appropriate. Nothing in these Terms requires electronic notice or service where law mandates another method.
Confidentiality, privilege and secure channels
Confidentiality and privilege are determined by applicable law, professional duties and the circumstances of each communication. Electronic transmission does not automatically remove protections, but a shared account, improper forwarding, insecure storage or unauthorized third-party access may create risks. Where appropriate, clients may be directed to Firm-approved protected methods. This website does not certify its general contact form as a HIPAA-compliant portal for transmitting protected health information.
Legal deadlines, emergencies and formal service
This website, contact forms, voicemail and inboxes are not monitored continuously and are not emergency legal services. If a deadline is approaching, take immediate steps to protect your rights and seek timely qualified legal advice. BOLO has no duty to file, appeal, respond, appear or take other action solely because an inquiry was submitted.
Unless expressly agreed or required by law, website forms, ordinary email addresses and social-media accounts are not designated to accept service of process, subpoenas, regulatory notices, court filings or other documents requiring formal delivery.
Jurisdiction and attorney licensure
BOLO is a New Jersey law firm. Brian M. O’Loughlin is admitted in New Jersey and the United States District Court for the District of New Jersey. The Firm takes on matters in other jurisdictions only to the extent permitted by applicable admission, jurisdictional and practice rules, including any required association with locally admitted counsel. Accessibility of a website in another state or country is not a statement of licensure there and is not intended as an improper solicitation.
Consultations, retainers and payment
Appointment availability and website descriptions of consultations, fees or potential services are informational until the applicable terms are confirmed. Representation, invoices, trust-account treatment, earned or refundable fees, costs and payment arrangements are governed by a separate agreement and applicable professional rules. Scheduling or making a payment, standing alone, does not expand or establish representation.
Marketing communications and testimonials
Professional announcements, legal updates and commercial communications are subject to applicable marketing and attorney-advertising requirements. Commercial email recipients may unsubscribe as required by law. Promotional telephone or text contacts may require separate consent. Prior matters, professional experience, testimonials or publications do not guarantee a similar result in any future matter.
Website security and acceptable use
You agree not to attempt unauthorized access, misuse forms, introduce malware, evade security protections, impersonate others to deceive, or materially disrupt the site. We may implement reasonable technical controls, remove abusive submissions or limit access where appropriate and lawful.
Copyright and permitted use
Unless otherwise identified, BOLO or an applicable rights holder owns original website content, branding and graphics. You may read and share links for lawful informational purposes; commercial reproduction, alteration, resale or false attribution without authorization may infringe rights. Fair use and other rights granted by law remain unaffected.
Third-party sites, tools and website availability
Links to government resources, scheduling, payments, video platforms or third-party websites do not constitute a guarantee of their accuracy, security, continued availability or terms. We strive for accurate, accessible and reliable operation but website content or systems may occasionally be unavailable, incomplete or outdated.
Privacy
Personal information practices, including website forms, cookies, analytics, advertising, email, SMS and video communications, are explained in our Privacy Policy. Use of the website does not authorize disclosure of privileged materials contrary to applicable professional obligations.
Accessibility and alternate communication
If you encounter an accessibility barrier or need an alternate reasonable way to communicate with the Firm, please contact us by telephone or email. We will evaluate such requests consistent with the circumstances and applicable law.
Limits on disclaimers
To the extent law permits, we do not guarantee uninterrupted access to the website or the accuracy of general informational material for every circumstance. Nothing in these Terms prospectively limits liability for legal malpractice, waives confidentiality or professional duties, restricts nonwaivable statutory rights, or displaces a governing engagement agreement. Any attempted disclaimer is limited to the maximum lawful extent.
Governing law and revisions
These website-use Terms are generally governed by New Jersey law, subject to any mandatory law applicable elsewhere. This provision does not select a forum for malpractice or other claims where such a requirement would be unlawful or inconsistent with professional duties. We may update the Terms prospectively and post a new effective date; website changes do not independently amend an existing written engagement agreement.
