BUSINESS, PROFESSIONAL AND WHITE-COLLAR INVESTIGATIONS
Received a Subpoena or Fraud Investigation Notice? Get Counsel Before Your Next Response.
A subpoena, investigator contact or fraud allegation can make ordinary business records feel suddenly consequential. The first response should neither assume wrongdoing nor overlook the legal duties created by the request. BOLO evaluates selected white-collar and business investigations by identifying the issuing authority, preservation requirements, procedural posture and need for additional specialized counsel, with careful attention to communications and the actual evidence.

First steps: preserve the notice and the evidence
The notice itself governs the immediate task. Before making a substantive response, identify the issuing authority, the precise request and any applicable deadline.
- Keep the complete notice, envelopes, attachments and delivery information together.
- Preserve the existing clinical, billing, business and electronic records without altering or backdating them.
- Identify the requested records, dates of service, personnel and claims. Track how any production is assembled and transmitted.
- Escalate urgent dates promptly. Do not assume an inquiry to the firm extends a government, payer or court deadline.
Important: These are general preservation principles, not instructions to withhold records, disregard a lawful demand or miss a deadline. The proper response depends on the actual notice.
Investigations and Allegations That Call for a Deliberate Strategy
The scope of an inquiry matters. Financial records, transactions, billing patterns, emails, internal investigations, and the identity of the investigating agency can affect the response.
Fraud and Financial Misconduct Allegations
Selected matters involving alleged billing irregularities, false statements, commercial misconduct, financial records, or questioned business transactions.
Subpoenas and Document Demands
Review of requested records, preservation duties, deadlines, privileges, potential objections, and coordination of accurate, legally compliant production.
Healthcare Enforcement Referrals
Matters that begin with program-integrity audits, payer investigations, overpayment reviews, or contacts from regulators and enforcement agencies.
Interviews and Internal Reviews
Counsel regarding requests to interview owners, professionals, or staff, and assistance evaluating the need for a targeted internal fact review.
What BOLO Evaluates Before a Substantive Response
1. Understand the agency and legal authority
We examine the notice, identify the requesting body and response date, distinguish voluntary contacts from compulsory demands, and assess jurisdiction.
2. Preserve the evidence and assess exposure
Relevant communications, files, accounting records, and clinical materials should be preserved. The firm reviews issues of privilege, accuracy, and potential parallel proceedings.
3. Develop the response and appropriate representation
We consider document production, interviews, communications, and options for resolving the inquiry. Some matters may require criminal defense or local counsel beyond BOLO’s engagement.
Questions Clients Often Ask
Does a subpoena mean I have been charged?
Not necessarily. A subpoena may seek information from a witness, record custodian, subject, or other participant. The document and surrounding facts determine its implications.
Should I delete informal messages or repair records?
No. Relevant records and communications should be preserved. Destruction, alteration, or backdating can create serious additional problems.
Can BOLO handle an investigation outside New Jersey?
Representation depends on the forum, jurisdiction, attorney admission, and the scope of services. Local or separately admitted counsel may be necessary.

Take Investigator Contact Seriously Without Guessing at the Next Step.
If a business or professional has received a subpoena, interview request, fraud allegation, or document demand, contact BOLO with the agency name, type of request, and stated deadline. Do not ignore compulsory legal process.
Do not submit confidential, privileged, or patient information through an initial inquiry. Representation requires conflict review and an engagement agreement.
Legal framework and official sources
A subpoena, a warrant, an administrative document request, and a civil enforcement inquiry invoke different powers and protections. Representation may involve federal or state procedural and constitutional considerations; the particular document, issuing authority and procedural posture must be examined before advice is offered.
